While Blanche recently issued a formal order stating that the 1.8 billion dollar pool of money had been rescinded, legal experts and political critics argue that his authority alone might not be enough to bury the project permanently.

The situation centers on a delicate compromise Blanche brokered with two holdout Republican senators who were hesitant about his confirmation. Although the agreement was intended to formally kill the fund, observers point out a significant loophole in how the rescission was executed. Because the funding mechanisms involve complex legislative overlaps, there is a growing concern that the executive order does not fully extinguish the financial authorization provided by Congress.

This uncertainty comes at a critical juncture for Blanche himself, as his future leadership of the Department of Justice remains undecided. The Senate Judiciary Committee is scheduled to vote Tuesday morning on whether to advance his nomination, making the status of this massive fund a primary talking point for lawmakers on both sides of the aisle.

If the loophole holds, it could create a scenario where subsequent administrations or judicial rulings revive the spending without needing further congressional approval.
