Prosecutors move to dismiss Reflecting Pool vandalism case, saying ‘botched installation’ to blame

Federal prosecutors have moved to dismiss the Lincoln Memorial Reflecting Pool vandalism case against former Olympian David Hearn, conceding in a court filing that damage to the iconic landmark was actually caused by shoddy workmanship and a rushed construction timeline rather than any deliberate act of destruction. The reversal marks a striking about-face for the U.S. Attorney’s Office for the District of Columbia, which had aggressively pursued charges against the 67-year-old after he was accused of ripping sealant from the bottom of the pool following a $14 million renovation project.

Hearn had maintained from the outset that he merely touched the water out of curiosity during a visit last month, a claim that now appears fully corroborated by evidence the government itself brought to light. In a filing submitted late Friday, prosecutors acknowledged they had relied on initial reports from the Department of the Interior and U.S. Park Police when securing the indictment. It was only afterward that Interior officials turned over additional documents revealing the real culprit: flawed installation by the contractor Atlantic Industrial Coatings, combined with what prosecutors described as a rush to finish the project before America 250 celebration events surrounding Independence Day.

The renovation has been plagued by visible problems almost since its completion, with the pool’s blue lining peeling off in large chunks and algae blooms turning the water a murky green. The project has drawn sharp criticism from lawmakers and the public alike as a wasteful use of taxpayer funds. U.S. Attorney Jeanine Pirro had previously characterized Hearn’s actions as a deliberate attack on a treasured national landmark restored through hard work by National Park Service staff — language his legal team is now throwing back at the government.

Hearn’s attorneys issued a blistering statement Friday evening saying the Trump administration owes their client a full apology. They argued that dropping the case does nothing to undo what they described as an abuse of power in arresting and charging a patriotic American who committed no crime. Their statement called the government’s approach ready, fire, aim, and demanded accountability for bringing a prosecution built on incomplete information that crumbled under scrutiny. NPR has reached out to both the Department of the Interior and the White House for comment on the dismissal and the broader failures surrounding the reflecting pool project.
